Of every question we hear from customers — in chat, in email, before checkout — "is this legal where I live?" is the one that comes up the most. It's a fair question, and the honest answer is: it depends on two separate layers of law, and only one of them is settled.
The Federal Layer: Settled and Consistent
The 2018 Farm Bill removed hemp — defined as cannabis containing no more than 0.3% Delta-9 THC on a dry-weight basis — from the federal Controlled Substances Act. THCa flower is sold in that raw, pre-decarboxylated state, so it falls under this federal definition of hemp, not marijuana.
That single fact is why THCa products can be legally manufactured, sold, and shipped across state lines under federal law, in a way that Delta-9 THC products from state-licensed marijuana dispensaries cannot. It's also the entire reason a THCa market exists at all.
The State Layer: Where It Actually Gets Complicated
Federal legality is necessary, but it isn't sufficient. States retain the right to regulate — or outright restrict — hemp-derived cannabinoid products within their borders, and a growing number have done exactly that since the Farm Bill passed. A product can be 100% federally compliant and still be restricted, taxed differently, or require age/ID verification beyond the federal baseline depending on where it's being shipped.
This is normal, not a loophole or a red flag — it's the same reason alcohol shipping rules differ state to state despite alcohol being federally legal. It does mean, though, that "is THCa legal" doesn't have one national answer; it has one federal answer and up to fifty state answers.
What tends to vary state to state
- Whether smokable hemp flower specifically is restricted — some states treat smokable flower differently from other hemp products even when both test under 0.3% Delta-9 THC.
- Total THC testing methods — a small number of states calculate compliance using "total THC" (which accounts for THCa's potential to convert) rather than Delta-9 THC alone, which changes what qualifies.
- Age verification and ID requirements at checkout and at delivery.
- Concentrate and hash restrictions, which are sometimes stricter than flower restrictions in the same state.
